Terms of Service

1. Platform Overview & Nature of Service

Not An Intern ("Platform", "we", "our", or "us") operates as a collaborative technology facilitator under the Information Technology Act, 2000. The Platform connects enrolled post-secondary students ("Fellows" or "Students") with micro, small, and medium enterprises ("Companies" or "Clients") to complete project-based agile challenges.

2. Independent Contractor Status (No Employment Relationship)

Crucial: Engagement through the Platform does not constitute an employer-employee relationship, apprenticeship, or formal labor contract under Indian Labor Laws, including the Apprentices Act, 1961, or the Code on Wages, 2019.

Students engage as independent project participants or freelancers. Companies are not obligated to provide statutory employee benefits, insurance, provident fund (PF), or employee state insurance (ESI).

3. Intellectual Property (IP) Transfer & Ownership

Work Product Assignment: Unless otherwise negotiated in a challenge brief, all final deliverables, source code, data scripts, and documentation developed by Students specifically for a Company project become the exclusive intellectual property of the commissioning Company upon completion and acceptance.

Pre-Existing Materials & Academic Attribution: Students retain ownership of any pre-existing code libraries, personal portfolios, or foundational knowledge. Students maintain the right to reference non-confidential project titles and summarized problem statements on their resumes and portfolios.

4. Confidentiality & Non-Disclosure (NDA)

All Students and Companies agree to treat non-public business information, proprietary data, customer records, and internal communications as strictly confidential. Students agree not to publish, reproduce, or disclose confidential Company assets to any third party without express written permission.

5. Platform Moderation & Limitation of Liability

Not An Intern facilitates challenge matching and team tracking. We provide the service on an "as-is" basis and make no express warranties regarding project turnaround accuracy or commercial viability. To the maximum extent permitted by Indian law, Not An Intern is not liable for indirect, incidental, or commercial disputes arising between Companies and Students.

6. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute or proceeding arising out of or related to the Platform shall be subject to the exclusive jurisdiction of the competent courts in India.
